Introduction :

Welcome to mediqueue mobile Application !

The terms “You” or “Your” refer to you as the user (irrespective of whether You are a Registered User (defined hereunder),HCS Registered User (defined hereunder), or a Non-Registered User (defined hereunder)). In the event the Application is being used by a person on your behalf, the expression “You” or “Your” or the “User” shall apply to such person as well.

The terms “We”, “Us”, “Company”, and “Our” refer to mediqueue.

These Terms of Use, Privacy Policy, together with any additional Service specific terms and conditions, other policies which may be applicable to specific portions of the Application and any disclaimers which may be present on the Application are jointly referred to as “Agreement” and constitute the terms of Your access and use of the Application named as mediqueue (together or individually “Service”) operated by Reactova and the Services (defined hereunder). Where any part of the Agreement is modified in accordance with the terms of the Agreement, the Agreement shall be enforceable in its modified form.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our application.

By downloading or accessing the Application to use the Services, you irrevocably accept all the conditions stipulated in this Agreement, the Subscription Terms of Service and Privacy Policy, as available on the Application, you acknowledge that you have read and understood Agreements, and agree to be bound of them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

Users :

“Registered Users” are users who have successfully registered themselves with Reactova through the Application by providing information that is true and accurate, and who can sign in to their account on the Application by providing their username and password.

“Healthcare Specialists” or “HCSs” are third parties including but not limited to clinic or hospital listed on the Application, also, includes their duly qualified doctors, consultants,, laboratory service providers, pharmacist other incidental and ancillary healthcare service providers listed on the Application and who interacts with Users as part of the Services.

“HCS Registered Users” are Registered Users whose profile has a unique identification attached to it including but not limited to UHID (unique health identification) or UMR (unique medical record). HCS Registered Users may not be permitted to access to certain areas of the Application.

“Non-Registered Users” are users who have not registered themselves on the Application. Non-Registered Users may not be provided access to certain areas of the Application.

Registered Users, HCS Registered Users and Non-Registered Users shall individually or collectively be referred to as “Users”.

Communications :

You understand that as part of Your registration process as well as in course of Your use of the Application, You may receive communication from mediqueue on Your registered contact information. These communications will relate to Your registration, Services provided by us, transactions that You carry out through the Application and any such information found suitable of Your attention by us. Please note that mediqueue will send these communications only to the contact details that You or HCS provide on the Application. It is Your responsibility to ensure that You provide the correct contact details for the transaction You wish to enter. Further, mediqueue may also send notifications and reminders to You for the features that You may be using on the Application. You hereby consent to receive such communications from mediqueue. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at [email protected].

Services :

We are going to provide some benefits to the users through our services keeping in mind the problems of the users. The Application named as mediqueue enables Users to connect with Practitioners through Book facility that allows Users book an appointment through the Application. The Application may be used to access a variety of healthcare services. Depending on the status of Your registration and subject to the limitations and restrictions imposed by medique, You may avail following services through the Application:

1. Users can enlisted their name online to a HCS with him/her, he/she wants to consult in offline.

2. Users can find out the specialized HCS, based on their own health issues or diseases.

The Application offers the following features :

For registered users : This is a basic platform which help the patients to find the medical helth specialists or doctors or HCS and help to grow a basic knowledge aboout the perticular specilist of a particular field. By using this application the user can :

Name enlisting : Enlist their name in the queue without going to the clinic, which save the visiting time of patients in enslisting their name ;
Access to HCS Profiles : Depending on the extent of information shared by HCSs at the time of registering with the Application, the HCS’s profile containing their name, qualification, experience, specialization, consultant fees, personal statement, education, professional memberships etc. can be accessed by You. The Application offers various search features to aid You in accessing HCS profiles.
Access to HCS Availability for in-person appointment : Based on information communicated by HCS, the Application shows indicative appointment slots available for in-person consultation at HCS’s premises.

For HCSs : This service provide “easy to use” facility

Conditions of Use :

You must be 18 years of age or older to register and use the Services,. By registering in, and using the Application or accepting this Agreement, you represent and warrant to Medique that you are 18 years of age or older, and that you have the right, authority and capacity to use the Application and the Services available through the Application, and agree to and abide by this Agreement. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.

Activation Policy :

The Website is accessible to registered users and healthcare practitioners. To use the service or the application all the users have to provide some certain information like email id or mobile number. The activation policy for :

Non-registered users : The non-registered users can use the service or the application as soon as the certain information of the user is provided. However, the service will be active after veryfication. To verify the user, mediqueue may send a verification code to the registered email id or mobile number. At the time of registration the user will be asked to create a password for sequirity purpose.
Practitioners or HCSs : The practitioners can register to the Application by providing their email id and mobile number. After that, the practitioners will have to fill up a form containing all the details about his education, experience and etc. The provided details will be verified by the mediqueue team in a face to face verification meeting. For the face to face verification, the practitioners can select a preferred appointment date and time by making a call to mediqueue team or through the Application. As soon as the verification process is completed , the practitioners will be able to use the service

Doctors or HCSs can use only Mediqueue verified picture as their public profile picture.We may ask the practitioners for a photography session. In the photograph session the practitioners have to wear their professional uniform.

User Responsibilities

Your use of this Application shall be subjected to the following terms and conditions:

You will observe and comply with the terms and conditions of the Agreement in letter and spirit;
You will not delete or modify any content of the Application including but not limited to, legal notices, disclaimers or proprietary notices such as copyright or trademark symbols, logos, that You do not own or have express permission to modify;
You will not decipher, decompile, reverse engineer, or disassemble the Mediqueue content;
You will not use any engine, software, tool, agent or other device or mechanism (such as spiders, robots, avatars or intelligent agents) to navigate or search the Application;
You will not remove any copyright, trademark registration, or other proprietary notices from the Application. You further agree not to access or use this Application in any manner that may be harmful to the operation of this Application or its content;
You will not use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent.
You will not frame or hotlink or deeplink any Mediqueue Content;
You will not use the Application and / or Services in any way that is unlawful, or harms Mediqueue or any other person or entity, as determined in the Mediqueue’s sole discretion.
You will not engage in any form of antisocial, disrupting, or destructive acts, including “flaming”, “spamming”, “flooding”, “trolling”, “phishing” and “griefing” as those terms are commonly understood and used on the Internet;
You will not introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
You will not take any action that may damage or falsify Company rating.
You will not otherwise attempt to interfere with the proper working of Service.

Prohibited Uses :

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

1. In any way that violates any applicable national or international law or regulation.

2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.

3. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter,” “spam,” or any other similar solicitation.

4. To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.

5. In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

6. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service or expose them to liability.

7. In a way that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

Without prejudice to the rights that Mediqueue may have under other provisions of the Agreement, where Mediqueue has reasons to believe that a User has violated a term or condition of the Agreement, then Mediqueue shall, in its sole discretion:

Suspend provision of Services; and/or
Suspend the account of the User until there is enough information available with Mediqueue to determine whether the User had violated a term or condition of this Agreement; and/or
Suspend or terminate the account of the User where Mediqueue has determined that the User had violated a term or condition of this Agreement; and/or
Approach User to make good that loss or damage caused to Mediqueue as a pre-condition to revoke the suspension; and/or
Take any such action against the User as it permissible under law; and/or
Raise invoice of Services availed by the User; and/or
Disable and/or delete such User Content that is in contravention of the Agreement while preserving such information and associated records for the purpose of production to governmental authorities for investigation purposes.

User consent and privacy :

If you wish to purchase or use any service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address. We may collect various personal information from you when you use the Application and for the features provided by the Application. Mediqueue may access to registered User’s personal email or phone number, for communication purpose so as to provide you a better way of booking appointments and for obtaining feedback in relation to the Practitioners or HCS and their practice.

Our Privacy Policy sets out terms with respect to :

The type of information collected from Users, including sensitive personal data or information;
The purpose, means and modes of usage of such information;
How and to whom Mediqueue will disclose such information;

So the User is expected to read and understand the Privacy and Policy, so as to ensure that he or she has the knowledge of all the facts. When You register or access the Application or otherwise provide Your personal information, You specifically consent to Our Privacy Policy & Terms of Use. Medique may use such information collected from the Users from time to time for the purposes of debugging customer support related issues. We may disclose/transfer/share Your Personal Information to the third party or HCS in accordance with applicable law and for the purposes as set out in the Privacy Policy. Mediqueue is required by law to maintain the privacy and confidentiality of Your medical information. We assure to take Your privacy seriously and to maintain privacy and confidentiality of the information provided by You to Us.

Mediqueue shall not be responsible in any manner for the authenticity of the personal information or sensitive personal data or information supplied by the User to mediqueue or to any other person acting on behalf of mediqueue. The User is responsible for maintaining the confidentiality of the User’s account access information and password, if the User is registered on the Application. The User shall be responsible for all usage of the User’s account and password, whether or not authorized by the User. The User shall immediately notify mediqueue of any actual or suspected unauthorized use of the User’s account or password. Although mediqueue will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of mediqueue or such other parties as the case may be, due to any unauthorized use of your account. If a User provides any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or mediqueue has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, mediqueue has the right to discontinue the Services to the User at its sole discretion.

If you realize that your account is being misused without informing you or any fake account has been created with your personal details or you are not lawfully authorized to that account, then kindly reach out to us immediately at [email protected].

Terms of use for Practitiners :

These terms are applicable only to HCS or Practitioners.

Listing Policy :
Profile Ownership and Editing Rights :

Mediqueue ensures easy access to the Practitioners by providing a tool to update your profile information. Mediqueue reserves the right of ownership of all the Practitioner’s profile and photographs and to moderate the changes or updates requested by Practitioners. However, Mediqueue takes the independent decision whether to publish or reject the requests submitted for the respective changes or updates. You hereby represent and warrant that you are fully entitled under law to upload all content uploaded by you as part of your profile or otherwise while using Mediqueue’s services, and that no such content breaches any third party rights, including intellectual property rights. Upon becoming aware of a breach of the foregoing representation, Mediqueue may modify or delete parts of your profile information at its sole discretion with or without notice to you.

practitioners will obliged to check all the patients, enlisted their name through this application . If this is not so then Practionars will have to show the valid reason behind this. Otherwise mediqueue may charge some ammount from the practitioners.The charged ammount will be selected by the mediqueue team on the basis of our rules and regulation described in privacy policy.
The Practitioner is and shall be duly registered, licensed and qualified to practice medicine/ provide health care, wellness services, as per applicable laws/regulations/guidelines set out by competent authorities and the Practitioner shall not be part of any arrangement which will prohibit him/her from practicing medicine within the territory of India. The Practitioner shall at all times ensure that all the applicable laws that govern the Practitioner shall be followed and utmost care shall be taken in terms of the consultation/ services being rendered.
Practitioner may collect their consultation fee through our application. But in this case we will allow to take half of the total consultation fee as the security charge. And the rest of the consultation fee should have to collect in the clinic or chamber. In any case if HCSs or Doctors increase their consultation fee, they have to inform us before two days of executing the decision through sending a mail to [email protected] or by calling us or a face to face meeting.
If any patients has already registered before the fee increased and showing the new fee in the doctors profile in the application, then the Doctors or HCSs and The clinics would be obliged to collect the old fee from the patients.

Contents :

Mediqueue collects, directly or indirectly, and displays on the Application, relevant information regarding the profile and practice of the Practitioners listed on the Application, such as their specialization, qualification, fees, location, visiting hours, and similar details. Mediqueue takes reasonable efforts to ensure that such information is updated at frequent intervals. Although Mediqueue screens and vets the information and photos submitted by the Practitioners, it cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts.

Our Service allows the registered Users to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.

By posting Content on or through Service, You represent and warrant that: (i) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright.

You retain any and all of your rights to any Content you submit, post or display on or through Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through Service. However, by posting Content using Service you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through Service. You agree that this license includes the right for us to make your Content available to other users of Service, who may also use your Content subject to these Terms.

Mediqueue has the right but not the obligation to monitor and edit all Content provided by users.

Mediqueue assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect User’s equipment on account of User’s access to, use of, or browsing the Website or the downloading of any material, data, text, images, video content, or audio content from the Website.

In addition, Content found on or through this Service are the property of Reactova or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us. If a User is dissatisfied with the Website, User’s sole remedy is to discontinue using the Website.

Patients Emergencies :

The Services are not a replacement for emergency services offered at hospitals and should not be accessed if the patient is in a critical condition. In Medical Emergency , please contact doctors or HCSs and/or rush to the nearest hospital. The emergency services for the critical patients totally govern by the Doctors or HCSs in the clinic or Hospitals, We do not provide the emergency service through the Application.

Book Appointment Facility :

Book facility that allows Users book an appointment through the Application. To book an apointment , the registered users have to select a doctor based on their health issues. After that they will asked for booking charge. They will get a confirmation message from mediqueue after completing their payment. The message will be sent to the registered mobile number or registered mail address.

The book facility will closed everyday depending on the HCS’s practice period. This book facility will remain closed in between the visiting hours for that day and will be opened as soon as the visiting hours finished.

The results of any search Users perform on the Application for Practitioners should not be construed as an endorsement by Mediqueue of any such particular Practitioner. If the User decides to engage with a Practitioner to seek medical services, the User shall be doing so at his/her own risk. Mediqueue will ensure Users are provided confirmed appointment on the Book facility. However, Mediqueue has no liability if such an appointment is later canceled by the Practitioner, or the same Practitioner is not available for appointment. Provided, it does not fall under the heads listed under the Mediqueue Guarantee Program, in which case the terms of this program shall apply.

Representations and Warranties :

By Using This Application, You hereby represent and warrant that:

You are 18 years of age or older and that Your use of the Website shall not violate any applicable law or regulation;
All registration information You submit is truthful and accurate and that You agree to maintain the accuracy of such information;
You as a Registered or Non-Registered User will use the Application solely for Your personal and non-commercial use. Any use of this Application or its content other than for personal purposes is prohibited.
Your use of this Application shall be subjected to the following restrictions:

4.1. You will not delete or modify any content of the Application including but not limited to, legal notices, disclaimers or proprietary notices such as trademark symbols, logos, that You do not own or have express permission to modify. copyright or

4.2. You will not decompile, reverse engineer, or disassemble the content, or

4.3. You will not remove any copyright, trademark registration, or other proprietary notices from the Application. You further agree not to access or use this Application in any manner that may be harmful to the operation of this Application or its content.

You will not use the Application and / or services in any way that is unlawful, or harms the Company or any other person or entity, as determined in the Company's sole discretion.
You will not engage in any form of antisocial, disrupting, or destructive acts, including "flaming", "spamming", "flooding", "trolling", "phishing" and "griefing" as those terms are commonly understood and used on the Internet.
You will not host, display, upload, modify, publish, transmit, update or share any information that —
1. belongs to another person and to which the user does not have any right to;
2. is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
3. harm minors in any way;
4. infringes any patent, trademark, copyright or other proprietary rights(s), violates any law for the time being in force;
5. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
6. impersonate another person;
7. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
8. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

Mediqueue represents and warrants that:

it is a company duly organized under the [Companies Act, 2013] and has the power and authority to provide the Services and the Application;
it has all permits, approvals and licenses necessary to carry out the Services and in fulfilling its obligations hereunder;
by entering into this Agreement, mediqueue does not violate any of the previous arrangements entered into with other entities to which it is a party;

These services are provided by company on an “as is” and “as available” basis. Company makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content or materials included therein. You expressly agree that your use of these services, their content, and any services or items obtained from us is at your sole risk.

Neither company nor any person associated with company makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. Without limiting the foregoing, neither company nor anyone associated with company represents or warrants that the services, their content, or any services or items obtained through the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the services or the server that makes it available are free of viruses or other harmful components or that the services or any services or items obtained through the services will otherwise meet your needs or expectations.

Company hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose.

The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.

Copyright Policy :

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to [email protected], with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”.

You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright’s interest;

2. A description of the copyrighted work that you claim has been infringed, including the address of the location where the copyrighted work exists or a copy of the copyrighted work;

3. Identification of the specific location on Service where the material that you claim is infringing is located;

4. Your address, telephone number, and email address;

5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

Payment policy :

This terms are applicable only to Users other than practitioners.You agree to pay all Service fees, consulting fees and other fees applicable to Your use of the Services. Users have to pay a service charge of ₹ 9 to enlist their name from home. Users may ask to pay consluting fees sometimes depending on the demand of Doctors. The amount of the consulting fees will depend on the requirement of the HCSs. The fees would be paid online through the facility made on the Application. And the remaining fees have to pay At the time of visiting the establishment of the Practitioner for Covered Consultation in the offline mood. The consultation fees may increase, though this decision will only depend on HCSs or Doctors. In that case Mediqueue will not send any pre-notification to the users. Users will be compeled to pay the increased fee, that will be shown in the doctors or HCSs profile page in the application.

All fees are exclusive of taxes. The payment process would be complete only on receipt of the amount to mediqueue designated bank account.

Third parties support and services are required to process online fee payment. Mediqueue is not responsible for any loss or damage caused to User during this process as these third parties are beyond the control of Mediqueue.

In order to process the payments, Mediqueue might require details of Your bank account, credit card or debit card number etc. Please check our privacy policy on how Mediqueue uses the confidential information provided by You.

You are solely responsible for payment of all taxes, legal compliances, statutory registrations and reporting. Mediqueue is in no way responsible for any of the taxes except for its own income tax.

Cancelation and Refund policy :

If the users wish to cancel his booked appointment with the doctors or HCSs, then they have to notify us with in a valid time period. The users will be given the opportunity to delete his already enlisted name from the list until the night before the appointment is successful. The process of cancellation will be stopped at 12a.m. of the night before the appointment is successful.

At mediqueue, we do our best to ensure that our customers are immensely satisfied with our service. And we are happy to offer a complete refund in the following circumstances.

If you cancel the appointment with in the appropriate time period assigned by mediqueue team.
If mediqueue cancel any appointment.

Following circumstances do not qualify to Return or Refund.

Users will not be entitles for any refunds in cases where, the Practitioner is unable to meet the User at the exact time of the fact whether the User is required to wait, irrespective of the fact whether the User is required to wait or choose to not obtain the medical services from the said Practitioner.
In case where the User, does not show up for the appointment booked with a Practitioner, without cancelling the appointment beforehand, the amount will not be refunded.

Reviews and Feedback :

By using this Application, you agree that any information by you with Mediqueue or any Practitionar will be subjected to our privacy and policy.

You are solely responsible for the content that you choose to submit for publication on the Application, including any feedback, ratings, or reviews (“Critical Content”) relating to Practitioners. The role of Medique in publishing Critical Content is restricted to that of an ‘intermediary’ under the Information Technology Act, 2000. Medique disclaims all responsibility with respect to the content of Critical Content, and its role with respect to such content is restricted to its obligations as an ‘intermediary’ under the said Act. Medique shall not be liable to pay any consideration to any User for re-publishing any content across any of its platforms.

You agree that mediqueue can ask you for the purpose of:

Obtaining feedback in relation to the mediqueue’s service.
Obtaining feedback in relation to the any practitionar listed in the application.
Resolving any complaints, information, or queries by the practitioners regarding your critical content.

and you agree to provide your fullest co-operation further to such communication by Mediqueue. Mediqueue’s Feedback Collection and Fraud Detection Policy, is annexed as the Schedule hereto, and remains subject always to these Terms.

You hereby agree not to post or publish any content on the Application that :

infringes any third-party intellectual property or publicity or privacy rights, or
violates any applicable law or regulation, including but not limited to the IG Rules and SPI Rules. Reviews and Feedback Display rights of Mediqueue :

All Critical Content is content created by the Users of www.Mediqueue.com (“Website”) and the clients of Mediqueue customers and Practitioners, including the End-Users. As a platform, Mediqueue does not take responsibility for Critical Content and its role with respect to Critical Content is restricted to that of an ‘intermediary’ under the Information Technology Act, 2000. The role of Mediqueue and other legal rights and obligations relating to the Critical Content are further detailed in Clauses 3.9 and 5 of these Terms. Mediqueue’s Feedback Collection and Fraud Detection Policy, is annexed as the Schedule hereto, and remains subject always to these Terms.
Mediqueue reserves the right to collect feedback and Critical Content for all the Practitioners, Clinics and Healthcare Providers listed on the Website.
Mediqueue shall have no obligation to pre-screen, review, flag, filter, modify, refuse or remove any or all Critical Content from any Service, except as required by applicable law.
You understand that by using the Services you may be exposed to Critical Content or other content that you may find offensive or objectionable. Mediqueue shall not be liable for any effect on Practitioner’s business due to Critical Content of a negative nature. In these respects, you may use the Service at your own risk. Mediqueue however, as an ‘intermediary, takes steps as required to comply with applicable law as regards the publication of Critical Content. The legal rights and obligations with respect to Critical Content and any other information sought to be published by Users are further detailed in Clauses 3.9 and 5 of these Terms.
Mediqueue will take down information under standards consistent with applicable law, and shall in no circumstances be liable or responsible for Critical Content, which has been created by the Users. The principles set out in relation to third party content in the terms of Service for the Website shall be applicable mutatis mutandis in relation to Critical Content posted on the Website.
If Mediqueue determines that you have provided inaccurate information or enabled fraudulent feedback, Mediqueue reserves the right to immediately suspend any of your accounts with Mediqueue and makes such declaration on the website alongside your name/your clinics name as determined by Mediqueue for the protection of its business and in the interests of Users.

Termination policy :

This Agreement will remain in full force and effect while You use the Application in any manner or capacity.

You can terminate Your relationship with Mediqueue by simply discontinue using Service. We would be interested to know the reason why you stopped using our service. But Mediqueue do not allow to delete any user account permanently.

If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies, including in particular our Community Standards, we may suspend or permanently disable access to your account without prior notice or liability. We may also suspend or permanently disable access to your account, if we determine that :

Any material relating to personal and medical information furnished by a User appears to be untrue; or
A User is critical or unstable or dead; or
Provision of Services poses a risk to life of HCSs; or
Financial dues have not been paid by a User within requested timeframe; or
User fails to co-operate with HCS or Medique; or
HSPs and/or other Medique resources are no longer adequate, available and/or suitable to accommodate User’s health requirements.

Once temporarily suspended, indefinitely suspended or terminated, the User may not continue to use the service under the same account, a different account or re-register under a new account. On termination of an account due to the reasons mentioned herein, such User shall no longer have access to data, messages, files and other material kept on the Website by such User. The User shall ensure that he/she/it has continuous backup of any medical services the User has rendered in order to comply with the User’s record keeping process and practices

Mediqueue reserves the right to suspended or withdrawn any non-paid version of any variant, tool, edition, add-on, and ancillary product or service of the Application from you personally or all users temporarily or permanently at any time and without notice. Medique may also impose restrictions on the length and manner of usage of any non-paid version of any variant, tool, edition, add-on, and ancillary product or service of the Application for any reason. Medique may change or update the non-paid version of any variant, tool, edition, add-on, and ancillary product or service of the Application without notice to you. If the need arises, we may suspend access to such part of the Application or close it indefinitely.

Records :

Mediqueue may provide Users with a free facility known as ‘Records’. Information available in your record are only user-created, information uploaded by in the time of registering and enlisting your name. Your Records is only created after you have signed up and explicitly accepted our “Terms and Conditions” and “Privacy Policy”.

In case you want to delete your medical Records, you can do so by contacting our service support team or using the given option in the Application. But Mediqueue does not allow you to delete the registration records, however you can edit this records as instructed in the Application.

To the extent that your Records have been shared with Mediqueue or stored on any of the Mediqueue products used by Practitioner’s you are visiting, and may in the past have visited, You hereby agree to the storage of your Records by Mediqueue pertaining to such previously visited clinics and hospitals who have tie ups with Mediqueue for the purposes of their business and for Mediqueue's services including but not limited to the usage and for storage of Records (as defined in Section 3.10) in India and outside India, in accordance with the applicable laws and further agree, upon creation of your account with Mediqueue, to the mapping of such Records as may be available in Mediqueue’s database to your User account.

Disclaimer regarding HCSs Service :

You understand and agree that any interactions and associated issues with the HCS(s) on the Website or the Application, is strictly between You and the HCS(s). You shall not hold Mediqueue responsible for any such interactions and associated issues.

User may expect the anticipated benefits from the Services provided by practitioners or HCSs, but no results can be guaranteed. User’s condition may not be cured or improved, and in some cases, may get worse. Mediqueue shall not be responsible for any breach of service or service deficiency by any practitioners. You acknowledge and confirm that Mediqueue shall not be responsible for Your treatment or be treated as a health care provider on account of collection of the consultation fees for private consultation by HCS. Every HCSs or practitioners are independet to collect their consultation fees. The fees could be paid online through the facility made on the Application or The fees could also be paid offline and be either collected personally from the User. Mediqueue is not liable of any transaction between practitioners and Users in offline mood or using other facilities without the means of our Application. We also have nothing to do with the increase in consultation fees.

Any modification, development, maintenance or updating of the Application and any modification, transfer, license or assignment of the rights in the Application shall be done by Mediqueue as per its sole judgment and in its sole discretion. Therefore, Mediqueue disclaims any responsibility towards Users in terms of development, maintenance and updating of the Application.
Please note that some of the content including text, data, graphics, images, information, suggestions, guidance, and other material that may be available on the Website or the Application may be provided by HCSs or practitioners. The provision of such content to You by Mediqueue does not constitute delivery of health care or diagnostic services to You and does not create a professional relationship between Mediqueue and You.
Mediqueue assumes no responsibility and shall not be liable for ways in which Your personal data is used. It is the responsibility of You alone to ensure that Your personal data is used in compliance to applicable privacy laws.

In no event, including but not limited to negligence, shall Mediqueue, or any of its directors, officers, employees, agents or content or service providers (collectively, the “Protected Entities”) be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the Website or the content, materials and functions related thereto, the Services, User’s provision of information via the Website, lost business or lost End-Users, even if such Protected Entity has been advised of the possibility of such damages. In no event shall the Protected Entities be liable for:

provision of or failure to provide all or any service by Practitioners to End- Users contacted or

managed through the Website;
any content posted, transmitted, exchanged or received by or on behalf of any User or other

Notwithstanding anything to the contrary in this Agreement, in no event shall the total aggregate liability of the Protected Entities to a User for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from the terms and conditions or a User’s use of the Application exceed, in the aggregate, INR 5000 or the amount of payment against Services that has been directly received by NTHS from the User in the past three months, whichever is lower.

Indemnification:

You hereby agree to indemnify, defend, and hold Mediqueue, Mediqueue’s contractors, agents, representatives and other authorized users (Registered and Non-Registered Users, Patients, HCSs), and each of the foregoing entities’ respective contractors, agents, representatives, service providers and suppliers, and all of the foregoing entities’ respective officers, directors, owners, employees, agents, representatives, harmless from and against any and all losses, damages, liabilities and costs arising from (i) Your use of the Application or Service (ii) Your breach of terms, conditions or provisions of this Agreement, or violation of any law, rules or regulations by the User, or due to such other actions, omissions or commissions of the User that gave rise to the claim., (iii) any negligent or intentional wrongdoing on Your part, (vi) misrepresentations or fraudulent feedback that has adversely affected Mediqueue or its Users, (v) User’s actions resulting from the User’s viewing of Content on Mediqueue Application, (vi) any legal or third party intellectual property right claim that may arise from the User Content and (vii) any such claim or liability arising out of unauthorized use of Application and content within the Application.

Applicable Law and Dispute settlement :

The interpretation of this Agreement and the resolution of any disputes arising under this Agreement shall be governed by the laws of India.

The parties shall have the right to apply to a court of competent jurisdiction to obtain interim injunctive relief in respect of any dispute, pending resolution of such dispute in accordance with the Agreement.

Miscellaneous :

Severability : If any provision of the Agreement is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision shall be excluded from this Agreement and the remainder of the Agreement shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms; provided however that, in such event, the Agreement shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal.

Notices: All notices and other communications required or permitted hereunder to be given to a party shall be in writing, in the English language, and shall be sent e-mail at the email address provided by You to us when You registered as a User, or delivered by hand or by messenger.

Waiver : No provision of this Agreement shall be deemed to be waived and no breach excused, unless such waiver or consent shall be in writing and signed by Mediqueue. Any consent by Mediqueue to, or a waiver by Mediqueue of any breach by you, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.

Complete Understanding: The Agreement contain the entire understanding of the parties, and there are no other written or oral understandings or promises between the parties with respect to the subject matter of the Agreement other than those contained or referenced in the Agreement.

Force Majeure: Mediqueue shall not be liable for any downtime or delay or unavailability of the Application caused by circumstances beyond mediqueue’s reasonable control, including without limitation, cyber-attacks, acts of God, acts of government, floods, fires, earthquakes, civil unrest, acts of terror, strikes or other labour problems, internet service provider failures or delays, or denial of service attacks.

Advertisement: Mediqueue shall have the right to place advertisements and publicity materials of its choice, including that pertaining to parties other than itself for commercial use through electronic means on the Application.

Assignment: You may not assign or sub-license, without the prior written consent of mediqueue, the rights, duties or obligations under this Agreement, in whole or in part, to any person or entity.

Conflict: In the event there is any conflict between the terms of the Agreement, the following order of prevalence shall apply: (i) any additional Service-specific terms and conditions that may be agreed by You (ii) Privacy Policy (iii) the Terms of Use and (iv) any other policies applicable to specific pages of the Application.

Survival: Even after termination, the provisions of the Agreement with respect to Platform as-is, Payment terms, Limitation of Liability, Indemnity, Intellectual Property, Dispute Resolution will continue and survive termination of this Agreement.

Modifications: Mediqueue reserves the right to modify any part of the Agreement at any time without giving You prior notice. No part of the Agreement shall stand modified unless consented to in writing by mediqueue.

When mediqueue updates the Agreement, We will notify you through an email. Alternatively, mediqueue may cause Your account to be logged-off in and make Your subsequent account log-in conditional on acceptance of the Agreement.

If You do not agree to the changes, please do not access or use the Application and the Services any further.
